1. About these terms
Welcome to Playdules, an educational technology platform providing interactive learning, games, creativity tools and related digital services.
These Terms of Service (“Terms”) govern your access to and use of:
- Playdules.com;
- Playdules web applications;
- Playdules accounts;
- Playdules games and learning experiences;
- teacher and classroom features;
- school administration and school SaaS services;
- content creation tools;
- artificial intelligence-assisted features;
- related digital products and services; and
- any other service that links to these Terms.
Playdules is a proprietary product and intellectual property of:
Noveldraw Creative
763, Abubakar Usman,
Jabi, Abuja, FCT, Nigeria.
In these Terms, “Playdules,” “we,” “us,” and “our” refer to Noveldraw Creative and the Playdules service.
By accessing or using Playdules, you agree to these Terms and our Privacy Policy. If you do not agree with these Terms, you should not use Playdules.
2. Eligibility
Playdules may be used by children, young people, parents, teachers, schools and other users. Where a user is a minor, the user may only use Playdules in accordance with applicable law and any parental, guardian or school requirements applicable to the relevant service.
Certain features may require:
- parental or guardian consent;
- school authorisation;
- teacher or administrator approval;
- age verification; or
- other forms of authorisation.
We may restrict or disable an account or feature where we reasonably believe that the required authorisation has not been obtained. Parents, guardians, schools and educational institutions are responsible for ensuring that children use Playdules in an appropriate manner and in accordance with applicable rules and permissions.
3. Children and students
Playdules may provide educational services intended for use by children and students. We recognise that children require additional protection when using digital services.
Where Playdules processes information relating to a child, we will handle that information in accordance with our Privacy Policy, applicable Nigerian data-protection requirements and other applicable laws. Where required, appropriate parental, guardian or school consent will be obtained.
Schools and teachers using Playdules are responsible for ensuring that they have the appropriate authority to create student accounts or provide student information to Playdules. Nothing in these Terms removes or limits any rights that children, parents, guardians or data subjects have under applicable law.
4. School and educational use
Playdules may provide a separate school environment that allows educational institutions to:
- establish a school account;
- create classes;
- add teachers;
- create or manage student accounts;
- provide students with access codes, links or QR codes;
- assign learning activities;
- create games and educational content;
- monitor participation;
- view scores and progress;
- manage teachers and administrators;
- manage school-specific settings; and
- access other school features.
A school using these services is responsible for:
- providing accurate information;
- ensuring that authorised persons administer the school account;
- obtaining required permissions and consents;
- ensuring appropriate use of student data;
- maintaining the confidentiality of administrator credentials;
- managing access by teachers and administrators; and
- using the service in accordance with applicable law.
Where a school subscribes to a paid Playdules plan, the school’s subscription is also governed by the applicable pricing, plan description, order, invoice or subscription terms presented to the school at the time of purchase.
5. Playdules service models
Playdules currently operates primarily as a freemium service. This means that certain Playdules features may be made available without payment, while additional features, capabilities or services may be introduced on a paid basis. We may also offer separate paid services for schools, educational organisations, teachers, creators or other users.
The features available under a free account may differ from those available under a paid account. We may change, add or remove features from free services, subject to applicable law and reasonable notice where required.
6. Free services
Certain Playdules services may be provided at no monetary charge. Free services may be subject to:
- usage limits;
- storage limits;
- feature limitations;
- account limitations;
- reasonable technical restrictions;
- availability restrictions; or
- other limitations communicated within Playdules.
The fact that a feature is free does not create an obligation for Playdules to provide it indefinitely. We may modify, suspend or discontinue free features where reasonably necessary for operational, technical, commercial, legal or security reasons. Where applicable law requires notice or provides consumer protections, those requirements will continue to apply.
7. Paid services
Playdules may introduce paid subscriptions, products, services or features. These may include:
- school subscriptions;
- school SaaS plans;
- premium teacher features;
- premium creator tools;
- additional storage;
- advanced analytics;
- additional administrative functionality;
- branded or white-labelled school environments;
- additional users or classes; and
- other premium services.
Before a paid transaction is completed, we will provide applicable information about:
- the service;
- price;
- billing period;
- applicable taxes or charges;
- material limitations;
- renewal arrangements where applicable; and
- cancellation terms.
The applicable price and plan presented at the time of purchase will govern that transaction.
8. School subscriptions
School plans may be offered on a subscription basis. A school subscription may be priced according to factors such as:
- number of students;
- number of teachers;
- number of classes;
- features;
- subscription period;
- storage;
- usage;
- institution size; or
- other plan characteristics.
The exact commercial terms will be presented before purchase. Unless otherwise stated, school subscriptions may automatically renew for the applicable subscription period where automatic renewal has been clearly disclosed and authorised. A school may cancel renewal in accordance with the cancellation process specified for its plan.
Cancellation of a subscription does not necessarily entitle the subscriber to a refund for a period already paid for, except where required by law or expressly provided in the applicable plan terms.
9. Pricing and changes to prices
Playdules may introduce or change prices for paid services. We will not charge a user for a paid service without the user or authorised purchaser agreeing to the applicable price.
Where a recurring subscription is affected by a price increase, we will provide appropriate notice before the new price takes effect, subject to applicable law. Nothing in these Terms authorises hidden charges. All material charges applicable to a transaction will be communicated to the customer before purchase.
The Federal Competition and Consumer Protection Commission recognises consumers’ right to clear information and disclosure of applicable prices, and Nigerian law prohibits unfair or unreasonable contractual terms.
10. Payments
Payments for paid Playdules services may be processed through third-party payment providers. We may not directly receive or store complete payment-card information where the payment provider processes that information on our behalf.
Users must provide accurate billing information and must be authorised to use the payment method supplied. A payment may be refused, reversed or suspended where:
- the payment is unauthorised;
- fraud is suspected;
- the payment method is invalid;
- a transaction is disputed;
- the account is subject to restriction; or
- required by law or by the payment provider.
11. Refunds and cancellation
Refund rights may depend on:
- the nature of the service;
- the applicable subscription;
- when cancellation occurs;
- whether the service has already been substantially used;
- the terms presented at purchase; and
- applicable Nigerian consumer-protection law.
Nothing in these Terms is intended to remove a consumer right to a refund or other remedy where such right cannot lawfully be excluded. Where Playdules is unable to provide a paid service for reasons within our responsibility, we will take reasonable steps to provide an appropriate remedy, which may include restoration of service, credit or refund where appropriate.
12. Account registration
Some Playdules features require an account. When creating an account, you agree to:
- provide accurate information;
- keep your account information reasonably current;
- maintain the security of your login credentials;
- not share credentials in a manner that compromises account security;
- promptly notify us of suspected unauthorised access; and
- use the account only for lawful purposes.
You are responsible for activities conducted through your account unless you can reasonably demonstrate that the activity occurred without your authorisation and despite reasonable security measures.
13. Google and third-party authentication
Playdules may allow users to create or access accounts through third-party authentication services such as Google. When using such a service:
- you must comply with the provider’s terms;
- you authorise the provider to authenticate your identity;
- Playdules may receive information made available through the authentication service; and
- the third party’s own terms and privacy policy may apply.
Playdules does not obtain your third-party account password through standard third-party authentication.
14. Acceptable use
You agree to use Playdules responsibly and lawfully. You must not use Playdules to:
- violate any applicable law;
- impersonate another person;
- create fraudulent accounts;
- access another person’s account without authorisation;
- harass, threaten or abuse another user;
- exploit, groom or endanger a child;
- distribute sexually explicit material involving minors;
- distribute illegal or harmful content;
- encourage violence or criminal activity;
- upload malicious software;
- interfere with Playdules’ infrastructure;
- attempt to bypass security controls;
- scrape or systematically extract platform data without permission;
- reverse engineer the service except where legally permitted;
- circumvent usage restrictions;
- exploit bugs or vulnerabilities;
- use bots or automated systems to abuse the service;
- conduct unauthorised commercial activity;
- infringe intellectual-property rights;
- upload another person’s private information without appropriate authority; or
- otherwise misuse the platform.
We may suspend or terminate accounts involved in serious violations.
15. Child safety and safeguarding
Playdules does not permit behaviour that exploits, harms, threatens, grooms or sexually exploits children. Users must not:
- solicit inappropriate personal information from children;
- attempt to arrange inappropriate contact with children;
- encourage children to leave appropriate educational or parental supervision;
- engage in sexualised communication with minors;
- distribute sexual content involving minors; or
- use Playdules to facilitate exploitation or abuse.
We may investigate suspected violations and take appropriate action, including restricting accounts, removing content and reporting conduct to relevant authorities where required or appropriate.
16. User content
Playdules may allow users, teachers and schools to create or upload content. This may include:
- text;
- images;
- educational materials;
- games;
- questions;
- quizzes;
- designs;
- audio;
- video;
- responses;
- lesson materials;
- comments;
- feedback; and
- other content.
You retain ownership of intellectual property that you lawfully own in your content. However, by submitting content to Playdules, you grant Playdules a limited, non-exclusive, worldwide licence to host, store, reproduce, process, display and otherwise use that content as reasonably necessary to:
- operate Playdules;
- provide requested services;
- display the content to authorised users;
- provide classroom functionality;
- back up and secure the service;
- improve the service;
- moderate content;
- prevent abuse; and
- comply with law.
This licence does not transfer ownership of your underlying intellectual property to Playdules.
17. School content
A school or teacher may create educational materials using Playdules. Unless otherwise agreed in writing, the school or teacher retains ownership of content it independently owns.
However, the school grants Playdules the permissions reasonably necessary to host, process, display and deliver that content through the Playdules service. Schools are responsible for ensuring that they have the rights and permissions necessary to upload content. Schools must not upload copyrighted, confidential or personal information unless they have an appropriate legal basis or permission to do so.
18. AI-generated content
Playdules may provide artificial intelligence-assisted tools. AI-generated content may include:
- game concepts;
- questions;
- stories;
- learning activities;
- designs;
- educational materials;
- suggestions; or
- other generated content.
AI-generated material may contain errors, omissions, inappropriate suggestions or inaccuracies. Users and teachers should review AI-generated educational content before using it with students. Playdules does not guarantee that AI-generated content will always be:
- accurate;
- original;
- suitable for a particular age;
- factually complete;
- educationally appropriate; or
- free from unintended errors.
Where AI-generated content is used in an educational environment, the teacher or responsible adult remains responsible for reviewing the material for suitability.
19. Intellectual property
Playdules and its underlying technology are proprietary to Noveldraw Creative. Except for content lawfully supplied by users, Playdules owns or has appropriate rights to:
- the Playdules name;
- logos;
- branding;
- website;
- software;
- source code;
- interface design;
- graphics;
- platform architecture;
- databases;
- proprietary systems;
- original educational materials;
- platform-generated assets;
- documentation; and
- other Playdules intellectual property.
Nothing in these Terms grants you ownership of Playdules intellectual property. You receive only a limited, non-exclusive, non-transferable right to access and use the service in accordance with these Terms.
20. Playdules brand
You may not use the Playdules name, logo, trademarks or other branding in a way that suggests:
- endorsement;
- sponsorship;
- ownership;
- partnership; or
- official affiliation
unless we have given you permission. Schools participating in a paid or white-labelled Playdules programme may receive additional branding rights under their applicable agreement.
21. Educational disclaimer
Playdules provides educational tools and interactive learning experiences. Playdules is not a substitute for:
- professional teaching;
- parental supervision;
- professional educational assessment;
- medical advice;
- psychological advice;
- legal advice; or
- other professional services.
Educational results may vary between users. Teachers, parents and educational institutions remain responsible for determining whether a Playdules activity is appropriate for a particular learner.
22. Platform availability
We aim to keep Playdules available and reliable. However, we do not guarantee that the service will always be:
- available;
- uninterrupted;
- error-free;
- secure against every possible threat; or
- compatible with every device or browser.
Temporary interruptions may occur because of:
- maintenance;
- upgrades;
- technical problems;
- internet connectivity;
- third-party infrastructure;
- security incidents;
- force majeure events; or
- other circumstances outside our reasonable control.
23. Changes to the service
Playdules is an evolving platform. We may:
- add new features;
- modify existing features;
- discontinue features;
- change technical requirements;
- introduce new service tiers;
- introduce paid features; or
- change how particular features operate.
Where a material change substantially affects a paid service, we will provide appropriate notice where required by law or the applicable subscription agreement.
24. Third-party services
Playdules may depend on third-party services, including:
- cloud hosting providers;
- authentication providers;
- payment processors;
- analytics services;
- AI providers;
- email providers;
- communications providers; and
- other technology providers.
We are not responsible for independent failures or policies of third-party services outside our reasonable control. Where third-party services are necessary for Playdules to operate, we will take reasonable steps to select appropriate providers and manage relevant risks.
25. Privacy
Your use of Playdules is also governed by our Privacy Policy. The Privacy Policy explains:
- what personal data we collect;
- why we process it;
- how we protect it;
- how we handle children’s data;
- when information may be shared;
- data retention;
- international transfers; and
- data-subject rights.
The Privacy Policy forms part of these Terms. Read the Privacy Policy.
26. Feedback
If you provide suggestions, ideas, recommendations or other feedback about Playdules, you agree that we may use that feedback to improve or develop our services without owing you compensation, provided that such use does not unlawfully disclose your confidential information or personal data. You do not transfer ownership of your existing intellectual property merely by providing feedback.
27. Reporting problems or abuse
If you encounter:
- inappropriate content;
- abuse;
- suspected child-safety concerns;
- account compromise;
- privacy concerns;
- copyright infringement;
- security vulnerabilities; or
- other serious misuse,
please contact us.
Customer Support: customer@playdules.com
For urgent child-safety or serious abuse concerns, please clearly identify the nature of the concern in your message so that it can be prioritised.
28. Copyright complaints
If you believe content on Playdules infringes your copyright or other intellectual-property rights, you may contact us at customer@playdules.com. Your notice should identify:
- the protected work;
- the allegedly infringing material;
- where the material appears on Playdules;
- your relationship to the rights holder;
- relevant supporting information; and
- your contact information.
We may remove or restrict access to content where appropriate while investigating a legitimate complaint.
29. Suspension and termination
We may suspend or terminate an account where reasonably necessary if:
- the user materially breaches these Terms;
- the user engages in unlawful conduct;
- the account presents a security risk;
- the account is used to abuse or endanger another person;
- the account is used to exploit children;
- fraudulent activity is suspected;
- payment obligations are materially overdue;
- the user attempts to circumvent restrictions;
- continued use could cause significant harm to Playdules or other users; or
- we are required to do so by law.
Where reasonably possible and appropriate, we may provide notice and an opportunity to remedy the violation before termination. Serious misconduct may result in immediate suspension or termination.
30. School account termination
If a school terminates a paid Playdules subscription:
- access to paid features may end at the conclusion of the applicable subscription period;
- school administrators may lose access to administrative functionality;
- teachers and students may lose access to school-specific features; and
- data may be handled in accordance with the applicable school agreement, our Privacy Policy and applicable law.
Where appropriate, schools may be provided with a reasonable opportunity to export or retrieve relevant school data before permanent deletion, subject to technical limitations, legal requirements and the applicable subscription terms.
31. Effect of termination
When your Playdules account is terminated or deleted:
- your right to use the applicable service ends;
- access to certain content may cease;
- licences granted to Playdules for operating the service may continue for limited purposes such as backups, legal compliance or dispute resolution; and
- provisions that by their nature should continue after termination will remain effective.
32. Disclaimer of warranties
To the maximum extent permitted by applicable law, Playdules is provided on an “as available” basis. We do not guarantee that the service will always meet every user’s particular requirements. However, nothing in these Terms is intended to exclude or limit a consumer right, statutory warranty or protection that cannot lawfully be excluded under Nigerian law.
33. Limitation of liability
To the maximum extent permitted by applicable law, Noveldraw Creative will not be responsible for indirect or consequential losses arising from use of Playdules. This may include losses resulting from:
- temporary service interruption;
- loss of data caused by circumstances outside our reasonable control;
- third-party service failures;
- unauthorised access despite reasonable security measures;
- loss of expected educational outcomes; or
- misuse of the service by a user.
However, nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including liability arising from fraud, intentional misconduct or other matters that cannot lawfully be excluded. Nothing in these Terms is intended to deprive consumers of mandatory rights provided under Nigerian consumer-protection law.
34. Indemnification
Where legally permitted, a user may be responsible for losses reasonably suffered by Noveldraw Creative as a result of the user’s:
- unlawful use of Playdules;
- material breach of these Terms;
- infringement of another person’s intellectual-property rights;
- misuse of another person’s personal information; or
- intentional or fraudulent conduct.
This section does not require a consumer to indemnify us for losses caused by our own unlawful conduct or for liabilities that cannot legally be transferred to the consumer.
35. Dispute resolution
We encourage users and customers to contact us first so that we can attempt to resolve complaints promptly and fairly.
Customer Support: customer@playdules.com
For school customers, the applicable school agreement may establish additional dispute-resolution procedures. Nothing in these Terms prevents a consumer from exercising any statutory right to seek redress through a competent Nigerian regulatory body, court or other lawful mechanism. The Federal Competition and Consumer Protection Commission provides formal complaint-resolution mechanisms for consumers who have first engaged the relevant service provider.
36. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria. Subject to any mandatory consumer rights or jurisdictional requirements, disputes relating to these Terms or the use of Playdules may be brought before a court of competent jurisdiction in Nigeria.
37. Changes to these Terms
We may update these Terms from time to time. When we make material changes, we may provide notice through:
- Playdules.com;
- the Playdules application;
- email;
- an account notification; or
- another appropriate method.
The updated Terms will include a revised Last Updated date. Your continued use of Playdules after the effective date of updated Terms may constitute acceptance of the updated Terms where permitted by law. If you do not agree with a material change, you should stop using the affected service and, where applicable, cancel your subscription.
38. Severability
If any provision of these Terms is found to be unlawful, invalid or unenforceable, the remaining provisions will continue to apply to the extent permitted by law. The invalid provision will be interpreted or replaced to the extent necessary to give effect to its intended purpose while remaining lawful.
39. No waiver
If we do not immediately enforce a provision of these Terms, that does not mean that we have permanently waived our right to enforce it.
40. Entire agreement
These Terms, together with the Privacy Policy and any applicable subscription, school or service-specific agreement, constitute the agreement governing your use of the relevant Playdules service. Where a separate written agreement exists between Playdules and a school or organisation, that agreement may take precedence over these Terms where expressly stated.
